I think steve's point was not so much that he objects to the shorting, but that the victims are still out of luck. In fact, new victims are created as the short requires additional buyers.

Is it legal? of course. Is it ethical? When the stock is over-valued and it's just a sell-buy play then this answer is obvious. When it is a known scam and the stock may be halted/delisted and worthless... well you are playing by the rules but effectively selling swamp land to an ignorant buyer.

To each his or her own, but i tend to side with steve on this one. There are risks in the market, and everyone should be aware of them if they choose to play. But sometimes i enjoy telling someone they dropped a $10 bill and handing it back rather than pocketing it. I guess steve is saying, it's the fact that there is no way to give it back that $10. Once they dropped it, someone else will take it no matter what.
