" Why have lawyers if you, the company,...can't rely on them"

K, if I can call you by your first letter, you must be more focused in your thinking, or you will never figure out what happened/ happening here.

Enron lawyers work for Enron, not you. They have no duty to you, and it is this duty that you would have to have which would yield liability of the lawyers to you.

Arthur Anderson did have attorneys. These attorneys are the ones who ALLEDGEDLY seem to have advised Arthur Anderson to destroy documents.

IF that is the case, and IF that is illegal or wrong as a matter of law, then Arthur Anderson is responsible for their actions under Respondiat Superior.

But Arthur Anderson undertook a duty to you, in my opinion, to issue to you an audit statement in which they had had a conflict of interest which they did not properly disclose to you.

They did not tell you that they were also getting 30 Million dollars to advise Enron as to how to LEGALLY circumvent audit reports that they were giving to you.

They will claim that this is alright, and the Congress of the United States, which knew about all of this while getting political contributions, stood behind the accountant's position in the matter.

The above are from the facts of this case.

Hypothecical what ifs are USELESS. And of course, the word, "waco" in my previous post should have really been spelled, "Wacko", so I can see how you might have been confused.
