Hi - Judges are appointed in Massachusetts. And virtually impossible to remove short of outrageous misconduct.

I liken this case somewhat to a drunk driver who goes through a red light and kills another driver. If it is a first offense I believe a jail sentence would be very unlikely. Repeat offenders (drunk driving, not killing) can get very stiff sentences for causing a death, as much as ten years (I'm talking about the New England states). These kinds of life-altering events can happen to anyone. I have to say that probably a few times in my life I have gotten behind the wheel at a time when I Iikely would have failed a sobriety test, although I felt perfectly competent to drive my car a short distance to get home. If one was unlucky enough to have a pedestrian step out from behind a parked car at such a time, one's life could be changed forever.

If you are a repeat offender for drunk driving, I am all for a harsh sentence. For a first time offender I think something along the lines of what you suggest is a more appropriate form of punishment and atonement.

Hmmm....how do I put this...Oh yeah....I think you're crazy. He killed a man! What if it were your father who was killed? Would you be willing to say...ahh it was just an unlucky punch....yeah send the guy home. F*CK NO! Having been in more than a fight or two there comes a time when you have to back off.
