Someone, perhaps a carrier, needs to sue the FCC for a court order requiring it to enforce the 1996 FCC Amendments and for an injunction that it cease violating the law. The FCC is, imho, an illegal organization: There are far too many violations of the rights of others and ignoring of the law. It violated Qcom's rights; it violated NextWave's rights; and it refuses to enforce the 1996 amendments, which require things like portability of numbers. Then as part of the discovery someone ought to look into whether there is any corruption at the FCC, because it seems like it's in the pocket of ATT. The latest UWB proposal that would allow use of all frequencies essentially is, imho, an unlawful taking of property (in violation of the Constitution) from those cdma carriers who paid dearly for clear spectrum. The proposal would cause noise and destroy the competitive advantage of cdma carriers and American cdma technology. In addition, whatever benefit resulting from use of all frequencies would be overwhelmed by the destruction to technological advances to get greater efficiency (evdo for example) out of the spectrum; the more noise there is, the harder it is to get more throughput in the spectrum. I had hoped that Powell would make some changes, but he is as bad or worse than the Chairman from the Clinton administration. And, the problem is at the staff level. Some judge has got to stop them.
