I don't mean to suggest that "justice" can ever evaluate that. I suggest it as a guide for individual behaviour. They may not honor the principle, but I believe the principle is a logical one.

Society does not create behaviour (although they may influence). Each individual is reponsible for his/her interaction with others. Society sanctions behaviour, either for or against. We call revenge (or consequence) justice. But it is the individual who can act or abstain...because there is no justice for the hurtful consequence of an action.

So when I speak about not violating consent or competence, I am not speaking about considerations of "justice". I am referring to a moral principle that I think could be helpful for individuals to keep in mind as a guide to their interactions with others. How to pick out the thorns would be the job of "law". But the law punishes; it does not choose for individuals..
