In my mind it was clear that Amazon implied the payments were in cash. I cannot recall how it was presented but I read every press release, analyst report, etc. for years. There had to be some implication these were cash deals or I would not have been under that impression.

As much as I do not like Amazon and their management, the people filing this class action are whining over losses they deserved in my opinion. They are clearly complaining they bought Amazon stock at a high price due to these deals or bought the junk bonds. My opinion is these people had faith in the Amazon affiliates at that just as apparently Amazon did. I suspect every one would have made the same trade whether the statement or implication was cash or stock. One that strikes me as obvious was the Ashford.com deal. Ashford.com did not have the amount of cash that the deal required at the time so clearly one could figure out that deal was not cash.

I have learned that their is a lot of misleading in the markets. More so than I ever would have believed. One still chooses to participate in the market. No one made them do it. It is time people stop blaming others for their losses.

An exception might be Enron and more importantly, the lower level employees. What occurred to them including their pension was not something I am sure most were willing to risk. Thay have a right to complain and receive some compensation if possible.
