The issue was a Constitutional one of Equal Protection for all voters. Why should some votes be selectively culled and hand-counted in areas likely to benefit one candidate over the other, when other votes only got a machine count?
They shouldn't. It violates the Equal Protection Clause. Seven justices said so.

The irony, disclosed after the media recount, is that Bush would have won Florida even if Gore had gotten his selective hand recount.

The deadline I am referring to was by Federal statute, a "safe harbor" to protect the slate from challenge. It was the intent of the legislature to meet the safe harbor. That intent could not be fulfilled if the count proceeded under equitable rules. Therefore, the already confirmed slate was submitted, the recount abandoned.......
