I sympathize with the column overall. However, I do not think that reference to the Founders is sufficient to dismiss some of these issues. For example, it was not merely an activist Court that made the standards of federal separation of church and state apply to states. Under the doctrine of incorporation, which was held to be a pretty clear inference from the 14th Amendment, the Bill of Rights was held to apply to the states, although a particular state could add to it. Would any American now say that the right against self- incrimination should be limited to the federal courts? Additionally, it is not a small matter to say that some types of favoritism could amount to making Christianity "official", and therefore establish it, at least non- denominationally. The posting of the Ten Commandments is, at least arguably, crossing the line, and should not be so easily dismissed, just because it was a common practice formerly. But with such caveats, I agree that the idea of separation has often been pushed too far......
