The "Supremes" are appointed by the executive. It is inherently a conflict of interest for them to appoint or any any other way press the outcome of the selection of the executive. That is why Congress was tasked with the job of being the final arbiter for the Presidental Election. Scalia's usurpation of that role was unconstitutional and he should be impeached and removed for his action.
