"Bmy's case was made or lost months ago", Precisely so, the case was MADE months ago, and only a casual look at the dispute with Imcl bias will conclude that Imcl has any chance.

Many claim that BMY dd and had access to Fda communications and everything at hand to make an inform decision, BMY does not think so, otherwise Bmy is double stupid to demand anything in public so clearly.

Bmy has given plenty of chances to Imcl to solve problems friendly and Imcl has refused. Bmy is given time to the next FDA meeting that will bring a repeat rejection, then all Imcl chances are gone. Imcl mismanagement has caused a year or two of delays in the best case.

Imcl waksals past and recent past is full of proven and suspicious misdeeds. It is amazing that the country of the war on drugs is the same accepting a company leader proven cocaine transporter (oh yeah, overturn in technicality) 2 kilograms, thousands are in jail for grams and miligrams and the guy is free after 2 kilograms!

Are you choosing Imcl as the right party out of hopeful/grateful shareholder bias? fine. Just plain sympathy for Imcl? fine. Intensive pivotal facts? No way, you do not have any proof about that, you do not know the details of the deal, just the same generalities most know.

My opinion is not based in "pivotal facts", it is based on probability that the Imcl guy is clearly on the way of insider trading charges and the behavior of big corporations that will not be bluffing around just to lose.

The "analysts" like McCammant that is also a shareholder and his clients portfolio took a margin call recently, and some media calling Bmy poor chances are not neutral parties.

The least an investor could do with Imcl is sell to avoid further losses, hold if they are brave believer, buy if very very high casino style risks are in his veins. The signs has been given since the November drops from $70 to $55 with massive distribution cause by sam dumping, oh excuse me, tax related selling need! Or the January FORCED collateral loan related selling!

There are very serious "concerning" issues about the the regulatory process that could impact the long term viability of the product.

At the least, Bmy could step out and save $800M, they would still own the 20% of Imcl. But, Bmy wants more, Bmy wants the most they can get. In my view BMY will prevail on their terms.
