If a person commits rape and the victim chooses not to expose it (thereby resulting in charges not being
brought), a rape was nonetheless committed; <<<<<

No rape has occurred legally. It is just hearsay.

There is a difference between saying "X was never convicted of rape", and "X didn't rape anyone". Maybe by "no rape has occurred legally" you merely mean that there was no rape conviction, but your statement implies that by some legal standard there has been no rape, or that there was a legal determination that no rape occured. The 1st is uncertain and the 2nd is not true.

Wrong. Doesn't the constitution say explicitly that every one is assumed innocent until proven guilty.

One is assumed to be innocent in terms of legal consequences. That doesn't mean that one is as a matter of fact innocent or that individuals can not decide for themselves that the facts seem to indicate that someone is guilty.
