Umm, have the courts ever held running ads is part of freedom of speech? It is not obvious that it is... I think the first amendment would apply the same way it applies to Newspapers and other media. If a newspaper can print whatever it wants (at least "truthful" things) because of the 1st amendment, I should be able to buy whatever kind of ad I want whenever I want. If you argue that restraining my ads is not a violation of my 1st amendment rights, then I would argue that the same would need to apply to any news reporter. They could just speak to the people around them like I could.

If their had never been a violation of a specific legal right and thus no court history about the right a violation of it would still be a violation of that right. I'd even go so far as to say that if a court wrongfully determines a case that it is allowing a violation of a legal right rather then changing the right.
