Yes he is at risk (even if in this case the risk is small) but you can say someone committed a crime without a conviction. If you get sued you do not need beyond all reasonable doubt evidence to defend yourself. Also you can always say "I think that OJ did it", and your only risk would be that some court goes wacky and doesn't follow the law correctly.
