How often are plaintiffs found guilty?

Not often enough. RMBS may have gotten away with their fraud if they hadn't made two mistakes: (1) Joining JEDEC; and (2) once in, refusing to disclose their patents and apps. They could have easily smoozed their way to a 0.01% royalty on DDR and possibly SDRAM.

But clearly they didn't believe they had the EE design skills to avoid being designed around so they decided to bluff their way to the big pot. The incredibly insane thing about this whole sad affair is that (a) they clearly didn't have to be in JEDEC to know what JEDEC was doing; and (b) they were so incredibly heavy handed in lifting JEDEC work for their patent amendments.

Everyone knew what they were doing. They forced this as a RMBS or JEDEC fight to the death, winner take all. The Fabs had to have known this from the time ADT group was formed. It literally had no reason to exist beyond the threat RMBS posed to JEDEC's process. Of course, no one would have bothered if they had known that RMBS would be as bad at fraud, as they were at memory design. Who could have possibly imagined the attorney-client disclosures in this case. I've read a lot of cases, but that was a new one on me for a civil case.

There are no doubt 8 million lessons in the now naked City of Los Altos; but the one most important to future fraud artists is simply this: If you are going to try to scam a mature Mega Billion dollar industry, never get greedy and leave them no alternative but peel your onion in open court.
