I think Cheney would be covered by this. Actually the members of his cabinet would be covered by that phrase as well.

But since the talks were with non-government officials that might knock over Cheney's argument.

Also some of the limits of executive priviledge are really uncertain. It isn't specifically mentioned in the constitution. According the the court it is implied but the exact limits haven't been nailed down.
