I preclude nothing, but economics will have its effects on marginal plays like RCN. RCN is a marginal play because if they demonstrate a market exists, it can be easily taken away by the RBOC, just due to natural economies. Like the satellite phone business has evaporated. Demonstrate there is a localized market anywhere in the world, and a cellphone tower will go up there for a few bucks and undercut you.

I presume billing will be monthly, not use-based.

SANs can provide the bandwidth needed. They will be be located at the headends of the cable operators, or at the CO's of the telcos for the most part.

Eminent domain may be tried, but is not an issue at all. This is a communications rate standard, and both sides can work under the same legislation.

I know of at least two plays doing 10Mbps EtherNet over twisted pair with very good reach. Add cable, and the last mile does not need fiber, or wireless, or microwave, for sure.

Sustainability is content and monthly fee, and it is there, today, at least for cable.

All legislation is quid pro quo, just most of the time the public gets left out and pockets get stuffed. This idea puts the public first, and leaves business to business by leaving the price variable open, but forcing competition. Which is IMO, what government is supposed to do.
