Maybe he just ignored it thinking nothing would happen? Kinda dumb but you never know.

Since the plaintiff claimed Whatley was served via certified mail, it should be a simple matter to look at the receipt and see if he signed it or not.
If plaintiff screwed up and defendant was never legally served, seems to me the whole thing should get tossed out, w/plaintiff billed for court costs.
