ACTION AGAINST IAMGOLD COMPLETED MARCH 1, 2002
The damages portion of Kinbauri Gold's action against Iamgold Corp. was
completed on March 1, 2002. Kinbauri presented evidence in support of a
claim for $8.16-million to be assessed as of either December, 1993, or
March, 1996, with prejudgment simple interest of 9.1 per cent per year,
punitive damages of up to $2-million, legal and other fees of $416,000,
plus costs. Iamgold presented evidence denying that Kinbauri suffered any
damages, that Iamgold was responsible for fees totalling $416,000 and that
Iamgold warranted assessment of any punitive damages against it. Justice
Sedgwick of the Superior Court of Justice (Ontario) reserved judgement, but
indicated that he would issue his judgement in the near future. Other
matters were addressed by both parties at trial, but were for the most part
peripheral to the main issues as above outlined.
Kinbauri's action was due to a breach of contract by Iamgold in 1991.
Kinbauri had previously received a favourable ruling from Justice Sedgwick
on the liability portion of this action on May 31, 1999. This decision was
upheld by the Ontario Appeal Court on Nov. 2, 2000. Leave to appeal the
Ontario Appeal Court decision by Iamgold was dismissed by the Supreme Court
of Canada on Sept. 13, 2001.
