slacker--The delay in resolving the problem is now inevitable. However, Congress still could intervene, making the case moot. Congress could mandate a settlement, overruling the FCC, and also wording its legislation in a way that would negate the reauction by authorizing a settlement along the lines previously suggested by NextWave and the reauction bidders.

It seems to me that only the FCC is in favor of court resolution, and the time and cost of obtaining it may be enough to sway Congress to listen to the corporations that are involved here.
