Both NextWave and the reauction bidders had a tentative settlement agreement that would have required Congress to pass a law allowing it. The bill didn't make it to the Senate floor in December because of objections from Sen. Hollings. Exactly, now you want to somehow believe that it is the FCC that wants court action, and Congress wants a settlement?? That's 180 degrees from 2 months ago. There is extreme pressure from both the Executive and Legislative Branches on this subject! Nextwave will have to start selling their D,E Block licenses in order to pay for the Supreme Court battle. Stick a fork in it.. Nextwave is dead! But the main point is that both NextWave and the bidders had agreed upon a settlement. Nice of them to agree on selling goverment property without it's approval! But, it seems that the Government was not akin to deal. Now they will get NOTHING!! And they will have 100 million in used radio infrastructure lying around!! When it fell through, NextWave then said it would start using the spectrum itself, providing more CDMA services. 100 million in infrastructure for 80 markets!! LOL!! The Kool-Aid drinkers are really out in force. What Nextwave has done is build "protection builds".. They are offering NO SERVICES! No matter what they tell you! Of course many have believed their continued line of tripe that they have spewed from the begining! LWIN has more in infrastructure in Phoenix alone!! Like I keep on saying.. 5 years they have held Detroit, Madison, and 3 other D,E Block licenses.. ZERO, ZERO services being provided in 5 years!! I think you were joking? PCSTEL
