Even if they had taken this last proposal to settle it now, all would have been out building networks, and promoting this new stuff fast.

Ego, Greed, partisan politics.......it gets real old...

the other bad thing is that once you enter the case into the Supreme court, it will stay there and cannot be withdrawn, so once they accept the case, it is locked in and will sit until 2003 (or 2005) when it really gets settled. It will take a full act of Congress to remove it and even then it gets very close to the violation of the spearation of powers. the mess will continue guaranteed now for another 2-3 years. Plus the lawsuit on the behalf of the depositors in all this.

the good thing is that this has no effect on QCOM, as they have already writtenn down the loss and have not included any upside in subscribers due to NW in any projections. It will also guarantee that the spectrum is bound up until 2004. Perhaps this is exactly what AWE wanted to happen so they could prolong it until the economy downturn is over without having to come up with the rest of the money they owe.

Agreed, the FCC should have immediately revoked their licenses in 1996 when it was discovered that Nextwave had LIED on their applications both to participate in Auciton 5, and their subsequenT License applications! In addition, they should have fined and sentenced the Directors of the Company to prison terms for making willfully false statements on a Government application, which stated that Willfully False Statements are punishable by Fine and/or imprisonment. It's a case of justice will prevail.

Michael Powell is too much a politician to open himself to charges that he gave away $18 billion of public money to het 11 billion. This wah he can simply say that others made his decisioh for him --ie, the Senate refused the settlement and he dod the only thing left to do -- took it to the supreme court. When you see a big screw up on the way, it's good to spread the responsibility around to as many others as possible.
