thanks for the link to the latest brief; there may not be a lot of difference between the two. will read it when i get a chance; i will try to figure out what might have peeked the interest of at least 4 justices; might have been not much more than conservative judges wanting to reign in on agencies. or clarification of the police, regulatory power exception from certain bankruptcy provisions. NW's brief in opposition to cert is on the corporate website.

btw, release today: for first time in january, more folks surfed net on broadband than narrowband. are there implications for wireless data? does it mean users will be unsatisfied with slowness of data upgrade paths? or alternatively, does it mean users will demand more data services at the rates that will be available (and not be dissatisfied)?
