I'm not trying to say that Skilling is blameless in all of this. I came to this scenario by first asking myself why Skilling would testify rather than take the 5th. Then, as he began to testify I asked myself if there was a plausible scenario in which he was mainly telling the truth. (That is, glossing over his motives for getting out of there.) So I came up with the preceeding post. There may be other plausible scenarios, there may be good reasons why he didn't stay and fight through the problem he may have perceived. I can see him concluding that Fastow was Lay and the Board's fair haired boy and a darling of the business press and that if he set off an inquiry his chances of winning the political battle were nil. And he may not have known enough to be sure that the inquiry he would set off could turn up enough really strong facts to insure his success.
