I don't have a clue. I've never seen anything better than what Cohen wrote.

Having said that, I would have reservations about putting someone on an appellate court who was that controversial. Appellate court judges should be utterly reliable, even boring. When in doubt, I think that has to trump potential unfairness to the candidate. There are lots of excellent candidates to choose from.
