That's a real interesting idea...hadn't thought of it before. The thing that troubles me most about the death penalty is that a bunch of people on death row have recently been exonerated based on DNA and other evidence. Which proves that the justice system isn't capable of convicting only the guilty. As long as the system can't do that, we shouldn't be killing people, or at least not except in those rare cases where we are absolutely sure they did it. The Illinois governor basically suspended application of the death penalty here for that reason. We have a political court system, run by the same people who brought us the "vote early, vote often, keep voting when you are dead" system. Hardly a recipe for fairness and justice.

I suppose that even with DNA evidence there is the opportunity to rig the game, but perhaps with blind testing carried out simultaneously by independent and respected labs, we could be sure enough to carry out the sentence in some cases.
