stimulus, I believe the reason they can file is because the potential liability could possibly make them insolvent.

For example, I don't think they'd be able to file Chapter 11 without the lawsuits pending, so it has to be the key factor in determining their assets and liabilities, at least that's how it worked for Dow Corning and Johns Manville, i believe.
