The constitution says all men (that has been broadened to include women also) are created equal. That is interpreted in the philosophical sense, as pertaining to rights because obviously all men aren't created equal in the literal sense, some people are better than others in mentality, or sports, or music etc etc etc. (Most people can't hit a baseball as far as Hank Aaron, play the guitar as well as Clapton, or add up all that money the liberals want to give away to people as fast as your average democrat can LOL no matter what the constitution says)

The third type of human means that they get rights because they are homosexuals, which wasn't considered in the constitution seperately.

If they aren't a third type of human then they already have the same rights that anyone and everyone else does.
