with the provision that if it were ever erroneously applied, the judge, jury, and executioner involved would all be executed as conspirators in the murder of an innocent.

If it wasn't a capital case would you apply a similar standard and make the judge, jury, and prison warden + guards, criminally liable for abduction and false imprisonment, and perhaps civilly liable for any suffering that occurred while in prison?
