Although that is only part of the story. After the USSC shot down the death penalty and CA finally got a law passed that met their objections, it was still quite a while before it effectively was legal again. The state supreme court chief justice was Rose Bird and she never saw a death penalty she liked. She overturned every one that came before the court. Fortunately, supreme court justices have to be periodically reconfirmed by the voters in CA. After it became apparent what she was doing, a stink was raised and she and several other justices that voted with her failed the confirmation vote. New justices were appointed with a different point of view.
