That is a horse of a different color. You have now mixed apples and oranges. Congratulations. I do not think the government (government government government) should be trying to get people twice using civil rights violations. I think private individuals should be able to do whatever they want to in the courts- which is what we were talking about before. Before we were talking about private party lawsuits. I cannot imagine why you would talk about these two very different things as if they were at all related.
