Its still amounts to signing something unconstitutional (unless Bush has changed his mind about that, but I haven't).

I suppose it could be supporting and defending as a matter of tactics (i.e. "the court will reject this and then it will help support the idea that this is unconstitutional"), but the action itself isn't unless you think the constitution is just whatever the court says it is. I don't.
