March 1, 2002 Xybernaut Cybersmear Suit Results in $450,000 Default Judgment; Defendant Says He Was Never Served and Knew Nothing About Lawsuit
On March 1, Jeffrey Benner released an article on Wired News noting that Dan Whatley has learned that a $450,000 default judgment was entered against him in a corporate cybersmear lawsuit brought by Xybernaut, a Virginia company that makes wearable computers. Although the default judgment reportedly was entered on June 22, 2001, Mr. Whatley reportedly learned of its existence when someone claiming to be the Chief Financial Officer of Xybernaut, John Moynahan, reportedly posted it several weeks ago to a Xybernaut message board. While the Xybernaut lawyer handling the case reportedly says Mr. Whatley was served with the summons and complaint by certified mail, Mr. Whatley contends that the address used for service is an "empty warehouse" at a location where he has never lived. He further notes that he has not lived in Miami for over 25 years and has lived at his present address for the last five years.
