MS Judge Urged to Levy Fine

WASHINGTON -- A Microsoft rival says a hefty fine, not business restrictions, is the best way to end the giant computer software maker's desktop monopoly.

A federal judge who is considering antitrust penalties was told Tuesday that changes recommended by nine states could have the wrong effect, freezing out competitors. Mitchell Kertzman, head of the interactive television software company Liberate Technologies, urged U.S. District Judge Colleen Kollar-Kotelly to focus on financial penalties.

If it were Microsoft doing the same thing, I imagine you'd be characterizing it as bargaining in a free market.
