Brazil's Anatel may take over Opportunity telecom assets if co dissolved
AFX Europe; Apr 5, 2002

LONDON (AFX) - Brazil's telecom regulator Anatel could take control of the telecom operators in which CVC/Opportunity Equity Partners Ltd has an equity stake, including Brasil Telecom SA, if the company were to be dissolved, Brazilian media reported.

The dissolution of CVC/Opportunity Equity Partners could constitute a substantial alteration of the ownership structure of the telecom operators and trigger the intervention of Anatel.

Newspaper Jornal do Brasil reported that Anatel has formally asked Opportunity to provide information on a UK court decision against the head of the Opportunity investment bank, Daniel Dantas, and Citigroup Inc.

The court allowed Luiz Roberto Demarco, a former business partner of Dantas, to request the dissolution of CVC/Opportunity Equity Partners Ltd, which based in the Cayman Islands, JB reported.

The decision was taken by the House of Lords' Privy Council on March 21.

Opportunity holds stakes in Brasil Telecom -- along with Telecom Italia SpA --, in Telemig Celular and in Amazonia Celular.

Folha Online quoted an industry expert as saying that the options for Anatel could be either to deprive the new owner of the stakes formerly held by Opportunity of its management rights, assume direct control of the telecom ventures or revoke the concession granted to the operators.

Demarco, who owns 3.5 pct of CVC/Opportunity Equity Partners, has been trying for three years to sell his stakes but has failed to reach an agreement with Opportunity, JB reported.
