Dan, Here is the actual lawsuit filed against MER. Got it from BWAC on another board.

After reading through the lawsuit is is easy to see that MER and the others may have problems. Here is an example below that came out this am. This fron USB Warburg on AAPL.

"We doubt that Apple will meet March quarter expectations because of the supply constraints and rapid channel stocking very late in the quarter - but we believe this is somewhat expected and will be overshadowed by the second half earnings outlook," UBS Warburg analyst Don Young told clients. <<<

Now I don't have a problem with others opinions but when they come out and move a stock to their highest rating and then say that AAPL may miss earnings I think this is a dis-service to those that take or pay for their advice. It is pure speculation that AAPL will do better in the second half. I assume that a "strong buy" means buy it today without hesitation. I think those buyers could take a substantial hit if indeed AAPL does miss earnings. Why not wait until after earnings to rate it.

Anyway, this upgrade may set up a great short op. I'm going to start researching the brokers. I have really never traded them much. Any ideas anyone.
