In fact, new evidence demands a new trial.

That certainly cannot be so. If it was, every trial verdict would only be a tentative conclusion, left open for perpetuity and for additional trials every time some new piece of evidence might be discovered.

Obviously, the standard for a reversal and a new trial is much higher than that ... and rightly so.

Perhaps one of our lawyer-posters can tell us the law on this matter..
