I gotta say, if the best that Microsoft's lawyers can do in a cross-examination is to get an opposing witness to withhold comment on a portion of the case, they've got trouble... Where I come from, "I have no opinion on that matter; I'm an economist, not a technologist" is a perfectly reasonable answer to any question.

I'd also say that barring extremely good or extremely bad news from the court, investors needn't bother too much with the day-to-day happenings of this particular portion of the lawsuit. It can however be useful to look at the overall feeling of the judge toward the parties involved. My experience with RMBS and MSFT has indicated that extremely adverse rulings are usually signposted pretty early in the trial. Judge fancy-name in this case has been pretty restrained overall, which probably means that she will hew pretty closely to what the appeals court told her to rule (and if you don't think the appeals court spelled out the ruling they're looking for... read their opinion).

Further, when it comes down to it, the opinion of the appeals court and the Supreme Court are much more important than the opinion of the trial court judge in this case. This isn't always the case, but in a case of such astounding national importance as this one, you can bet that the judges at the circuit and supreme level will not let this go in a direction they deem improper.
