Ideally the commons is divided up in to various properties which people would own. But there are a lot of political problems when trying to do this in the oceans and also fish don't stay in one area all of the time, they move, so you would still have an incentive to get as many of them while you can even if the fishing rights where privately owned, so I suppose government regulations (and maybe even international treaties for the open ocean) might be needed.
