The natural way to look at items as to whether they should be a concern is whether they affect people in common and not just the property owner. The commons need a custodian. You can have a private custodian, for example Microsoft is private custodian over software interfaces, a common resource, but they are less concerned with the common welfare than would be a regulator ultimately bound by elections.
