It sounds that way since it sounds accusative, but if you read closely, you will find that opportunistic doesn't mean unethical. Further, there is no manipulation occurring since the risk is still there. Who says stocks will rise? What if they fall due to exogenous forces? The mechanism is engaged by the institutions in order to manage their systematic risk, not necessarily to realize a gain. It isn't the trading public or hedge funds who are buying all those small lots. It's other institutions who are.

Richard Ney's complaint was that stock prices should do what would benefit him. His allegations had no merit whatsoever. He would make elaborate arguments that proved he was wrong or that he didn't understand that the function of the specialist isn't to bail out the public, but to make a continuous market.
