Ah yes, but to transfer the trademarks and patents to a related entity outside the US they would have to charge that entity the fair market value of the patents and trademarks and they could charge only an arm's length royalty charge for their use thereafter.

This talk of Enron evading taxes mystifies me. They went bankrupt; there WERE NO PROFITS TO TAX. They told the truth to the tax man and lied to everyone else. It was an elaborate scam. Doesn't anybody read?
