In extraodinary circumstances yes. If the courts and the police are too overloaded then lesser crimes don't get as much attention. That reality not just with war crimes but with regular crime.

I think you could attack the rail road infrastructure before Dresden and after Dresden and even in Dresden without almost burning down the city. Of course those attacks would cause civilian casualtees too but not as many.

Depends on what you mean by bigger guns. You might shoot the gunman, but I wouldn't call in an artilary barrage on him.
