This indicates one of 3 things:
1)AMD doesn't have the intelligence to search and see if a name is taken. A simple google search would have caught this one.
2)AMD already has a deal with Opteron
3)They knew it was taken and are hoping for a confrontation that get's the AMD name in the press (cheaper then all those ads Intel has to run). In the end they get Opteron or a new name is chosen with much more press then if they chose an unused name in the first place. Remember all the press Intel got over the chipset code name Triton?

Nitt
