If the standard by which we judge law itself is predictability and consistency, ancient law was quite admirable.

The Code of Hammurabi, for example, while draconian in its punishments, was nevertheless quite consistent and predictable, two of the hallmarks of due process. It's quite incredible, really.

The point, of course, was to regulate human behavior according to objective standards, rather than letting man deal with man without restraint by social bonds.

I think it is one of the highest functions of mankind.
