Elmer,

The point is that there has been a severe yield problem and management has told you straight to your face that AMD had excellent yields when they knew it wasn't true.

And what would be the basis of the suit? That Jerry's cubicle is full of unsold die only up to his waist as opposed to up to his ears?

The numbers shown in the CC are sufficient evidence to support a class action suit based on known industry standards and AMD's public statements.

There is no industry standard, other than Intel. Would Intel provide the breakdown of their yields by product / process technology? Or should IBM be brought in about yields on their Power4?
