CyberCare Announces Successful Mediation of Class Action Suit

CyberCare Announces Successful Mediation of Class Action Suit

BOYNTON BEACH, Fla., Apr 26, 2002 (BUSINESS WIRE) -- CyberCare, Inc.
(Nasdaq:CYBR) today announced that the consolidated class action litigation
pending in federal court in the Southern District of Florida has been resolved
at mediation, with a Memorandum of Understanding being executed by the parties'
counsel. The Memorandum of Understanding provides for a settlement amount of
$3.1 million in cash, payable under an insurance policy, and issuance of 5
million shares of CyberCare common stock. The resolution is subject to
definitive settlement documents to be prepared and executed in the near future,
and court approval. The Company has been vigorously defending the consolidated
action, and has admitted no wrongdoing as part of the settlement. The settlement
also applies to the management personnel named as defendants in the litigation.

"We are pleased that the mediation was successful and to put this action behind
us," said Joseph Forte, President and CEO. "This litigation unfortunately has
required us to divert certain of our attention and resources to defend
ourselves; now we can return to our primary focus of strengthening the Company's
business operations and financial resources. Resolving this litigation will
allow us greater opportunity to pursue funding opportunities while minimally
impacting the Company's existing financial resources and dilution to
shareholders. We view this as a major step in our planned path forward,
resolving the legacy issues facing the Company," Forte added.

OT - I agree with ya - Noone likes or wants to see anyone get hurt - No player wants to deliberately injure another.

Maclaren was looking to flatten him no question about that and he will pay 2-3 maybe 5 game suspension. but its not a 10 gamer and he should get to play in the next series. The fact that a lot of damage was done is very bad and very unfortunate. Cant let him get away with it but it is not anything like Domi's cheap shot. I tend to agree with Bob Mackenzies opinion on sportsecnter which is basically what I have stated.

Funny thing is I suspect cooler heads will prevail because if Therrian puts Odjick on the ice as a starter then it will getreal ugly right away - also if that happens and he goes after someone I guarentee you Therrian and Odjick will get the game misconduct.

This is bad for the NHL and I also think the critcim of the Refs in very unfounded an unfair - its is all a ploy by managers and the NHL should put a stop to it.

I once was one of 5 meatheads ( I wasnt a goon - I was someone that they could miss LOL) put in the starting lineup in a playoff series when we were down 3-1 in games and was very embarrased for myself my team and my coach. We were told to all drop em and grab someone "to set a tone" - I grabbed the smallest guy who was abuddy of mine and we just did a little waltz with some hugs and kisses LOL.
