yep JUSTA, BTK has some defective genes 8:55AM Biovail downgraded to Sell at BofA (BVF) 46.45: Banc of America downgrades to SELL from Mkt Perform for the following reasons: 1) despite the proposed FTC settlement on the 2nd Tiazac patent, firm questions mgmt's handling of the issue; 2) believes tracking rev and earnings progression has become almost impossible (co makes numbers but firm is unsure of earnings quality); and 3) valuation. Firm believes that co's results over the last 18 months were boosted by the commission of acts now deemed to be illegal by the FTC. Biovail management's mishandling of a patent case that resulted in a recent ruling that struck down its secondary patent for hypertension drug Tiazac ---here's one that really instils confidence..NOT-- The Federal Trade Commission took its strongest action yet against one of the drug industry's favorite tactics for hindering generic competitors, which could spell trouble for Bristol and other majors.
