suppose a sweet fellow bought tech and telecom that had fallen way over 50% from where it had been touted by various analysts, brokerages, media, etc.- and the stocks tumbled another 80% from where he bought them- and he bought from a deep discount broker- online- but reasoned that - since they were strogly recommended at much higher prices they were a good investment for the long term. now, it turns out- some of the touters didn't really believe in the stocks. there is no privity of contract. the deep discounter took orders- didn't recommend. is there a case against the merrills and salomons- although they didn't earn commissions- because the sweet fellow didn't want to cough up commissions of $200+ a trade, rather than $9/trade?
