AFFX chart looks nice as a short. Would be nice if it
could bounce up to the 24/25 area first though. A move to
21.00 would break a spread triple bottom. Next support at 18.50

SYMC, arguably one of the "generals", it is walking on a
tight rope right now. 37.00 is solid resistance while
current price is right on the BSL. Perfect shorting place
would be 37ish with a buy to cover at 38. Below 31, there
is nothing but air. With no PE, even with the great
products, this one can drop rather dramatically.

50pt Dow chart....not looking so hot. Still below the BRL.
10100 is going to be a tough nut going forward. 9850 is
support and if it doesn't hold things could get really
ugly. 9600 would be the next support and then 9300. This based on the 100pt chart.

SPX 10pt chart. A print of 1040 would give us another sell
signal. Still below the BRL. Below 1050, there is nothing
but air down to the September 2001 lows.

25pt COMP is another bearish story. Next support at 1575
and then we have the September lows coming up fast...as a
matter of fact, only 200pts lower than were we are now. I
think we overshoot the September lows.

The 4pt RUT really wants to roll over here. 460 next
support with a spread triple bottom and the BSL. Those
small caps have been holding up the market, could get ugly
when they decide to give up the ghost.

And as I am sure that you have noticed, the bpcompq is
still at relatively high levels. Still a lot of room to
the downside on this BP.

Check it out! The BPSPX is still at high levels, but check
out how far off the highs. Lots of damage still to be done
on this one. I am thinking that we start going long when
the BPSPX gets in the mid-twenties...well, maybe not long,
but close shorts if you know what I mean...:-)

JDSU has already far exceeded its September 2001 lows. A
clear indication that this stock is weaker than others in
the sector. Compare to PMCS which is still 40% higher
than its Sept lows (though significantly off its Dec 2001 highs).

OMIGOD! You probably haven't seen the VXN yet. As you know,
the VXN is inverse to the market. That means that a buy
signal on the VXN is a sell signal on the market. Would
you look at that triple top break and then followed by a
double top break? Right now, resting at the BRL and a
spread quad top. We break through these puppies and you
could see some acceleration in the downward momentum on the nazzy stocks.

The Law Firms of Neiman, Garland and Urbach Announce Class Action Against JDS Uniphase Corp.

NEW YORK--(BUSINESS WIRE)--May 9, 2002--The Law Firms Jeffrey Neiman, Joseph Garland and Mel Urbach filed a class action against JDS Uniphase Corporation (Nasdaq: JDSU - news) (the "Company") and certain of its officers and directors in the U.S. District Court for the Northern District of California, on behalf of all purchasers of of JDS Uniphase securities between July 27, 1999 and July 26, 2001, inclusive (the "Class Period").

The complaint charges JDS Uniphase and certain of its officers and directors with violations of the federal securities laws. It alleges, among other things, that during the Class Period Defendants were motivated to inflate the price of JDS Uniphase stock so the Company could make acquisitions using inflated stock and so the Individual Defendants, top officers and directors of JDS Uniphase, could sell their own shares at inflated prices. The Company also misrepresented, the complaint asserts, the success of its largest acquisitions, including Optical Coating Labs, Cronos Integrated Microsystems, E-Tek Dynamics, and SDL, Inc. The Individual Defendants and the Company's controlling shareholder took advantage of the inflation by selling or disposing of 25.2 million shares of their Company stock for proceeds of $2.1 billion. On July 26, 2001, JDS Uniphase announced a restatement of its March 31, 2001 results, the write-off of $44 billion in goodwill associated with certain acquisitions, inventory write-downs, and earnings per share for the 2001 fiscal year of $0.16, with an expected loss of $0.15 per share in its fiscal 2002. On this news, JDS Uniphase shares dropped to $7.90 - 94% below their Class Period high of $146.32.

If you purchased JDS Uniphase stock between July 27, 1999 and July 26, 2001, inclusive, you may move to be appointed lead plaintiff no later than May 26, 2002. Gold Bennett Cera & Sidener LLP Announces Class Action Lawsuit Against JDS Uniphase Corporation

SAN FRANCISCO, CA --(INTERNET WIRE)--May 5, 2002 -- Gold Bennett Cera & Sidener LLP announced today that it has filed a class action in the United States District Court for the Northern District of California, Case No. C-02-2137(SI), on behalf of purchasers of JDS Uniphase Corporation ("JDS" or the "Company") (NASDAQ:JDSU - news) common stock during the period of July 27, 1999 through July 26, 2001 (the "Class Period"). The defendants are JDS, certain of its officers and directors, and its controlling shareholder. The complaint charges the defendants with violations of the Securities Exchange Act of 1934.

The plaintiff is represented by the San Francisco law firm of Gold Bennett Cera & Sidener LLP. For more than 30 years, Gold Bennett Cera & Sidener LLP and its predecessors have successfully engaged in complex commercial litigation, including shareholder, consumer and antitrust class actions, in federal and state courts throughout the United States. Additional information about the firm can be found at www.gbcsf.com.

JDS designs, manufactures, and distributes fiber optic components for the fiber optic communications industry. The complaint alleges that the defendants represented that demand for its products was increasing and that the Company had controls in place to monitor any change in demand. The Company also made positive representations about the success of several acquisition it recently had made.

As a result of these and other representations made by JDS, the Company's stock traded as high as $146.32. However, on July 26, 2001, the Company announced that it would have to restate its financial results for the Third Quarter of Fiscal 2001 and write-off $44 billion in goodwill associated with the acquisitions. JDS also revealed that earnings per share for Fiscal 2001 would be just $0.16 and that the Company would incur a loss of $0.15 per share in Fiscal 2002. On this news, JDS shares dropped to as low as $7.90. The complaint alleges that, while the price of JDS' stock was artificially inflated, certain defendants unlawfully sold $2.1 billion in JDS stock based on inside information.

Berger & Montague, P.C. Sues JDS Uniphase Corp. on Behalf of Investors Who Purchased Common Stock Between July 27, 1999 and July 26, 2001

PHILADELPHIA, May 2 /PRNewswire/ -- On May 1, 2002, the law firm of Berger & Montague, P.C. (http://www.bergermontague.com) filed a class action suit against JDS Uniphase Corp. (Nasdaq: JDSU - news; "Uniphase") and certain of its principal officers and directors in the United States District Court for the Northern District of California on behalf of all persons or entities who purchased JDS Uniphase common stock between July 27, 1999 and July 26, 2001 the ("Class Period").

The complaint charges JDS Uniphase, certain of its officers and directors and its controlling shareholder with violations of the Securities Exchange Act of 1934. JDS Uniphase is a provider of fiber optic components and modules which form the building blocks for fiber optic networks. The complaint alleges that during the Class Period, defendants were motivated to inflate the value of Uniphase stock so that the Company could make acquisitions using stock and so the individual defendants, who are the top officers and directors of Uniphase, could sell their shares. During the Class Period, defendants represented that demand was accelerating and the Company's only problem was its ability to manufacture enough product to meet demand. Defendants represented that they had outstanding visibility, including demand for the Company's products through the end of fiscal 2001 ("F01," ended on 6/30/01), and that Uniphase had 80 engineers whose job it was to monitor customers and their inventory levels. As a result, defendants represented that Uniphase would learn about any slowdown in demand early. The Company also misrepresented the success of its largest acquisitions, including Optical Coating Labs, Cronos Integrated Microsystems, E-Tek Dynamics and SDL Inc. As a result of these positive statements, Uniphase stock traded as high as $146.32.

The Individual Defendants (all of whom were top officers and directors of the Company) and its controlling shareholder took advantage of the inflation, selling or disposing of 25.2 million shares of their Uniphase stock for proceeds of $2.1 billion. Then, on 7/26/01, Uniphase announced the restatement of its 3rdQ F01 results, the write-off of $44 billion in goodwill associated with its acquisitions, inventory write-downs and that F01 EPS would be only $0.16 and that it would incur a loss of $0.15 in F02. On this news, Uniphase shares dropped to as low as $7.90 -- or more than 94% lower than the Class Period high of $146.32.

If you purchased Uniphase common stock during the period from July 27, 1999 through July 26, 2001, inclusive, you may, no later than May 26, 2002, move to be appointed as a Lead Plaintiff. A Lead Plaintiff is a representative party that acts on behalf of other class members in directing the litigation. The Private Securities Litigation Reform Act of 1995 directs courts to assume that the class member(s) with the "largest financial interest" in the outcome of the case will best serve the class in this capacity. Courts have discretion in determining which class member(s) have the "largest financial interest," and have appointed Lead Plaintiffs with substantial losses in both absolute terms and as a percentage of their net worth. If you have sustained substantial losses in Uniphase common stock during the Class Period, please contact Berger & Montague, P.C. at investorprotect@bm.net for a more thorough explanation of the Lead Plaintiff selection process.

The law firm of Berger & Montague, P.C. has over 50 attorneys, all of whom represent plaintiffs in complex litigation. The Berger firm has extensive experience representing plaintiffs in class action securities litigation and has played lead roles in major cases over the past 25 years which have resulted in recoveries of several billion dollars to investors. The firm is currently representing investors as lead counsel in actions against Rite Aid, Sotheby's, Waste Management, Inc., Sunbeam, Boston Chicken and IKON Office Solutions, Inc. The standing of Berger & Montague, P.C. in successfully conducting major securities and antitrust litigation has been recognized by numerous courts. For example:

"Class counsel did a remarkable job in representing the class
interests." In Re: IKON Offices Solutions Securities Litigation.
Civil Action No. 98-4286(E.D.Pa.) (partial settlement for
$111 million approved May, 2000).

"..[Y]ou have acted the way lawyers at their best ought to act.

best representation that I have seen." In Re: Waste Management,

Apr 11 2002
9:29 AM In Play IBM subject of new investigation: SEC Insight (IBM) 89.01: -- Update -- The rumors of an SEC investigation mentioned in the 8:43 comment were apparently triggered by a report this morning from SEC Insight; that research firm issued a report claiming that the SEC initiated a preliminary inquiry of IBM starting on Feb 15 2002, the same day as the NY Times story detailing IBM's accounting for the optical division sale to JDSU; report says that this is a new investigation and speculates that it is still ongoing.

Apr 11 2002
8:44 AM In Play IBM rumors making the rounds again 89.01: Hearing trading floor rumors of an SEC inquiry into IBM regarding the sale of its fiber optic business to JDSU (this transaction was the subject of the Feb 15 NY Times article that hit the stock); no confirmation of the source of this talk or its accuracy - IBM has been hit by accounting-related rumors repeatedly of late, most recently last Friday when rumors of earnings restatement were heard.

Mar 13 2002
7:19 AM In Play Bernstein sees optical trough in summer, possible growth in Q4 : Bernstein initiates coverage of the optical space with an overweight rating, and initiates JDSU and AGR.A with OUTPERFORM ratings and GLW with MKT PERFORM; analysis suggests a trough of carrier long haul expansion capex this summer, and the resulting photonics rev bottom in Q2 could be followed by an acceleration of sequential growth in Q4. Firm is cautiously optimistic on long term growth, particularly for photonics as it should suffer less price erosion than the semi's. Also, firm initiates semi co's LSI with OUTPERFORM rating, and ALTR and XLNX as MKT PERFORM.

Mar 12 2002
3:32 PM In Play JDS Uniphase loses more ground on news of insider trading plan (JDSU) 5.95 -0.69: Falls to lows of the day on Dow Jones report that eight JDSU executives and board members officers have adopted trading plans to sell company shares, according to a Form 8-K filed today with the SEC.

Mar 11 2002
1:47 PM In Play CIENA rises on short-covering, takeover rumors (CIEN) 10.70 +1.43: -- Update -- As noted earlier, the telecom equipment group is having a very strong day. Pacing the group's advance is CIEN, which we are hearing is benefiting from Buckingham's upgrade of CIEN (+15.4%), SONS (+7.3%) and ONIS (+13%) to Neutral from Swap. Firm calls these names 'survivor' companies that should benefit from stabilizing order patterns. According to firm, investors have seemingly stopped reacting to bad news and are covering large short positions, which is typically the first step in anticipating a stock/sector recovery. Also contributing to CIEN strength is chat room rumor that CSCO could make a play for co at these depressed levels... Other movers of note today include GLW (+5.9%), JDSU (+3.8%).

Mar 8 2002
8:40 AM In Play Morgan Stanley sees telecom trading opportunity in Q2 : Morgan Stanley sees a trading opportunity in telecom equipment stocks such as CSCO, NT, LU, CIEN, and JDSU after Q1 warnings and earnings are out of the way; believes that late release of service provider budgets will lead to a weak Q1 followed by a Q2 sequential rebound of up to 10%; sees trade lasting until the second half when 2003 carrier capex budgets are announced.

Mar 8 2002
7:38 AM In Play JDS Uniphase downgraded at Merrill Lynch (JDSU) 6.41: Merrill Lynch downgrades to Near-Term NEUTRAL from Buy and trims ests; believes that recent visits with optical co's indicate the optical mkt may decline closer to 20% in 2002 vs old estimate of down 12%, and that carrier capex in 2003 may also decline further; also, current valuation does not leave much room near-term upside, and sees support at the $5 level based on trough valuations and resistance at the $8 level based on earnings power in a recovery environment.

Mar 5 2002
9:13 AM In Play Intel designing chips for fiber optic networks (INTC) 31.85: -- Update -- Traders citing Bloomberg are telling us that INTC has started building customized chips for fiber optic networks, with the intent of replacing bulky, labor-intensive modules with cheaper, smaller semiconductors; the fiber optics components mkt is currently led by JDSU.
