You might want to find the Solicitor General's Brief in the case. They take an interesting approach. Here's some "commentary" on the oral arguments: kenyon.com

I haven't read its entirety, but I suspect it could be used to allow Equivalents to limp along for another 10 years. This problem really should be addressed by legislation, but that's a multi-million dollar proposition these days.<g>

KM,

I hope you don't take my comments as assuming that you haven't already considered these issues. Frankly I hope that you have; and having done so reached some alternate view point if you are long. Its clearly not a risk I would want to take, but there are lots of longs here who will.

My "problem" is with those who would take that "risk" and then go file a class action suit when the game is over.
